Terms of service
These terms govern use of jaquelineclarkhalloween.com and purchases from JAQUELINE CLARK RB INC, 1 Hilltop Plz, Kittanning, PA 16201, United States. The shop name is Jaqueline Clark Halloween. If you do not agree, do not create an order.
1. The seller
The legal seller is JAQUELINE CLARK RB INC. Charges, packing slips, and refunds come from that company. Jaqueline Clark Halloween is the catalog name. Questions go to service@jaquelineclarkhalloween.com or +1 (724) 547-6390, Monday–Friday, 10:00 AM–6:00 PM Eastern Time.
2. Who may buy
You must be 18 or older and able to form a contract in your state. If you buy for a household, you are responsible for the account, the payment method, and anyone who uses the decorations you ordered. We do not knowingly take orders from children.
3. Accounts
An account is optional for browsing and required if you want order history in one login. You keep the password. Tell us if you think someone else used it. We may close an account that is used for card testing, fake addresses, or repeat abusive return patterns.
4. Catalog versus what ships
Listings show the style we intend to pack: height, color, indoor or outdoor use, whether it lights or moves. Photos are of the production sample or a unit from the same lot. Dye lots on fabric and molded plastic shift slightly. If a measurement is on the page, that measurement controls over a lifestyle photo that makes a piece look taller on a porch.
5. Seasonal stock and cancellations on our side
Halloween inventory is bought in lots and does not replenish the way soap does. If an item sells out after you pay and before we pack, we cancel that line and refund it. We do not substitute a different skeleton, wreath, or inflatable unless you ask for that swap in writing.
6. Orders are offers
Checkout is your offer to buy. We accept it when we send the confirmation email or when we charge the payment method and assign an order number. We can refuse or cancel an order for an obvious pricing error, a failed payment, a blocked address, suspected fraud, or an item we no longer have. If we cancel after a charge, we refund the charged amount.
7. Pricing errors
If a $149 yard piece is listed at $1.49 by mistake, we do not have to honor the $1.49. We will email you before packing. You can pay the correct price or we cancel and refund.
8. Payment
We accept the methods shown at checkout. The charge may appear as JAQUELINE CLARK RB INC or Jaqueline Clark Halloween. You authorize us to charge the merchandise, the shipping rate that applies that day, and sales tax collected on the ship-to address. If a payment reverses after we have shipped, you still owe the unpaid balance.
9. Sales tax
Page prices exclude tax. Tax is calculated at checkout from the delivery address. We remittance that tax as required for a Pennsylvania seller shipping inside the United States. We do not add a second tax after the fact.
10. Shipping, risk, and title
Shipping rules on the Shipping Policy page control the clock: 1–4 business days to USPS, 4:00 PM ET cutoff, U.S. addresses only, USPS only, estimated transit from Kittanning, PA. Title and risk of loss pass when USPS accepts the parcel. After that scan, a lost or delayed carton is handled under the 14-day notice rule on that same page, not as a new free order on demand.
11. No international sales
We do not ship outside the United States. We do not prepare export documents. A forwarder address used to leave the country is treated as an invalid destination. Those orders are cancelled and refunded.
12. No pickup
1 Hilltop Plz is a business address, not a retail counter. We will not hold a box for lobby pickup or meet you in the parking lot.
13. Returns and exchanges
The Refund Policy page is part of these terms: 30 days from delivery, unused with tags, prepaid label, we pay return postage, no restocking fee, refund to the original method within 10 business days after inspection, exchanges when stock exists. Final-sale and clearance lines are excluded when marked. Used outdoor décor is not unused.
14. How the decorations may be used
These are decorative products. They are not childcare articles, not climbing structures, and not toys for unsupervised children unless a listing expressly says otherwise.
Outdoor and lighted pieces: use a GFCI outlet, follow the printed outdoor rating, stake inflatables and tall frames against wind, and take fabric and paper items inside in rain. We are not responsible for a piece left in a storm, a tripped breaker, or a decoration placed in a driveway or sidewalk where someone walks into it.
Open-flame use is not authorized unless the listing is a candle product and you follow the warning on that item. Do not put a hot bulb against a wreath or fabric ghost.
15. Assembly and site conditions
Many yard pieces need two people, a level patch of ground, and the stakes that come in the box. If you assemble on a slope, skip the stakes, or cut the cord, that is outside the unused-return rule and outside any defect claim for the parts you altered.
16. Reviews and messages you send us
You may email photos of a defect. You may post a review if the site has that feature. Do not send us content you do not own. Do not post another person’s address or card data. We may remove reviews that are unlawful, that include personal data of a third party, or that are used to demand a refund outside the written policy. We may quote your service email internally to fix the order.
17. Site license and our marks
The site, photos, descriptions, and the names Jaqueline Clark Halloween and JAQUELINE CLARK RB INC belong to the company. You get a limited right to browse and to place an order. You do not get a right to scrape the catalog, copy our photos onto another store, or use the name to sell someone else’s décor.
18. Acceptable use
Do not: attack the site; test stolen cards; harvest emails; place orders with a false name and a vacant lot; threaten staff; or use the return label to send back a different product or empty carton. We can refuse future checkouts and report fraud.
19. Coupons and promotions
A code is good only for the dates, SKUs, and minimums printed with it. One code per order unless the offer says otherwise. We can cancel a code that was leaked or applied to a final-sale line that the offer excluded.
20. Communications
Order mail comes from service@jaquelineclarkhalloween.com. Transactional mail (confirmation, shipped, refund) is part of the purchase. Marketing mail, if you opted in, can be stopped with the unsubscribe link. Calling +1 (724) 547-6390 during posted hours is the phone channel. We do not take order changes by social-media comment.
21. Third-party tools
Checkout, tax calculation, and USPS tracking run on vendors we do not own. Their outage can delay a confirmation or a scan. That delay is not a defect in the decoration itself.
22. Disclaimer of extra warranties
We describe the item and honor the Refund Policy and any express statement on the product page (height, indoor/outdoor, lights). Beyond that, and beyond what Pennsylvania law does not allow us to disclaim, we do not add extra warranties of uninterrupted site uptime or of a specific porch photograph looking identical on your house.
23. Limitation of liability
To the extent Pennsylvania law allows, JAQUELINE CLARK RB INC is not liable for lost profits, lost event plans, or indirect damages. For a given order, our liability is limited to the amount you paid us for that order, including shipping and tax on that order. Some states do not allow certain limits; those limits do not apply where they are prohibited.
24. Indemnity
If you misuse a lighted or outdoor piece, ship us a fraudulent return, or use our photos on another store, you will cover the company for the claims and costs that come from that conduct, including reasonable attorneys’ fees, to the extent the law allows.
25. Force majeure
We are not in breach when USPS, weather, a power cut, a parts factory stoppage, or a government closure stops packing or transit. We email what we know. Refund and cancellation rights on undeliverable orders still apply as written on the Shipping and Refund pages.
26. Changes to these terms
We can update this page. The version that applies to an order is the version posted the day you paid, unless a change is required by law and must apply sooner. Continued use of the site after a posted change is acceptance of the new text for later visits.
27. Governing law and disputes
Pennsylvania law governs these terms and your order, without regard to conflict-of-law rules. Exclusive venue for a court action we or you file is the state or federal courts sitting in Pennsylvania, unless a statute that cannot be waived says otherwise. You and the company will first try to settle by email to service@jaquelineclarkhalloween.com for 30 days before filing, except for fraud or IP claims.
28. Assignment, severability, entire agreement
You may not assign an order. We may assign the company or the catalog. If one sentence is unenforceable, the rest stays. These terms plus the Shipping Policy, Refund Policy, and the product page for the SKU you bought are the agreement for that purchase. Website banners do not override a numbered paragraph here unless they expressly say they do.
